TERMS
- Farm-
- The land that is being operated by one producer with equipment, labor, accounting system and management substantially separate from that of any other unit. Land on whom tenants provide their own labor and equipment shall not be considered a separate farm.
- Farm Serial Number -
- The number assigned to a farm by the USDA - FSA county committee for purposes of identification.
- Quota Owner -
- A person or persons or entity that owns farm land in this state for which there is a currently established burley tobacco quota recognized by the USDA in accordance with the 1938 Agricultural Adjustment Act.
- Basic Quota -
- The pounds allocated by the USDA - FSA to a farm as the farm's share of the national marketing quota for burley tobacco.

1. What is the purpose of this money being paid?
- The state budget approved by the Kentucky General Assembly in April 2006 directed the Kentucky Tobacco Settlement Trust Corporation (KTSTC) to compensate crop year 2003 quota owners who did not receive payments under the plan adopted by the Kentucky Tobacco Settlement Trust Corporation on March 22, 2004.
This current application process is being conducted to certify and grant one-time payments to 2003 crop year quota owners who did not attain certification status with the Corporation in 2004.

- 2. Who will receive a claim form?
- The claim form is sent to the first quota owner listed according to the USDA Farm Service Agency on a farm with available 2003 quota pounds to be claimed.

- 3. Who is eligible to be certified for payment?
- Crop year 2003 quota owners who did not achieve certified status and receive payments under the plan adopted by the Kentucky Tobacco Settlement Trust Corporation on March 22, 2004.

- 4. Who will receive a check?
- A check will be provided to those individuals who return the claim form by the deadline and are successfully certified as eligible recipients during the application period.

- 5. What do I need to do to be certified for payment?
- If you are listed on the claim form as a quota owner, you must allocate and claim the available quota pounds, ensure that your contact information is correct, include your social security number or tax identification number, and provide your signature in the spaces provided Then return the claim form by July 31, 2006.

- 6. When is the application period?
- Claim forms will be mailed July 1, 2006. The postmark deadline for submission of claim forms is July 31, 2006.

- 7. When will the checks be mailed?
- The checks will be mailed the week of August 28, 2006.

- 8. When should I expect to receive my check?
- The check should have arrived between August 28, 2006 and September 1, 2006. If you were certified to receive a payment and have not received your payment by September 8, 2006 please call the call center to inquire about your claim.

- 9. How are the funds allocated?
- Quota owners are paid based upon 2003 farm records of tobacco quota pounds.

- 10. How much is being paid per pound?
- Payment is based upon certified eligible pounds claimed during the application periods.
The Kentucky Tobacco Settlement Trust Corporation was instructed to pay the same rate per quota pound claimed as the 2005 distribution. Therefore, the payment rate is $0.229 per pound.

- 11. How many years will the distributions be made?
- This is the final Phase II payment.

- 12. How do I change my address?
- We can change your address here at the call center for purposes of this distribution. However, you should always be sure to also change your address at the local FSA office so that they have accurate farm contact information.

- 13. Do I need to update my information for next year?
- No. Since this is the final Phase II payment, we will not be updating farm or payee related information.
